鶹Ƶengages in litigation through two primary avenues:

  1. Direct Litigation Participation: 鶹Ƶinitiates lawsuits as a lead plaintiff or co-plaintiff, directly representing the industry’s interests in court. Currently, 鶹Ƶis responding to federal government overreach by taking a whole-of-鶹Ƶapproach. Our policy teams lobby Congress, submit comments on agency rules, and engage with agency leadership. Our legal team is working with outside counsel to bring direct legal challenges in federal courts against regulators for their overreach. 
  2. “Friend of the Court” Legal Briefs: 鶹Ƶsubmits amicus curia (or “friend of the court”) briefs in court cases across the country. These briefs – sometimes submitted independently but more often in cooperation with other like-minded groups – present the industry's unique and compelling legal arguments and educate the court on the practical implications of its decisions on the construction industry.
